Request that the Board waive the $2,800 campaign finance late fee assessed against UA Local 198 PAC, a political action committee, its committee's chairperson, Neal P. Miller, and treasurer, Charles B. Habig, Jr, whose January 2019 Monthly Report campaign finance report was filed 14 days late.
Facts:
Neal P. Miller, chairperson for UA Local 198 PAC, states that they have been reporting contributions to the Louisiana Board of Ethics since 2014 and this is the first time they have received a Late Fee assessment notice. He states they were unable to send an electronic report timely due to computer issues in their office. Their reports can only be created using the software that could only be accessed from the computer that was down. They have addressed those issues and anticipate future reports will be sent timely. Our office spoke to the LA Board of Ethics Tech Support department for help sending the reports after the new computer was installed.

18:1505.4.A(1) Any candidate, the treasurer or chairman of a political committee, or any other person required to file any reports under this Chapter, who knowingly fails to file or who knowingly fails to timely file any such reports as are required by this Chapter may be assessed a civil penalty for each day until such report is filed. 18:1484.(2)(b). Each candidate for any other public office shall file reports of contributions in excess of two hundred dollars in the aggregate during the aggregating period.
Recommendations:
Suspend all but $400 based on future compliance.
