Request that the Board waive $360 and $360 campaign finance late fees assessed against John C. Reeves, a candidate for Judge, 7th JDC, Division A, Catahoula Parish, in the October 5, 2002 and November 4, 2014 election, whose 2018 Supplemental campaign finance disclosure reports were both filed 6 days late.
Facts:
John C. Reeves states that on or about the first of February of this year, he gave his secretary the letters that remind him to file his campaign finance reports. As judge of the 7th Judicial District Court, which is a two parish district, he alternates parishes week to week. When he gave his secretary the letters, they were in Concordia Parish. All of his campaign finance records are stored at his law office in Catahoula Parish which made it impossible for her file them at that time. The following week his secretary left for her honeymoon out of the country and was gone for a week. She returned just a few days before the report was due. Also, at the time of which his reports were due, they were getting ready to begin a two and half week long murder trial. He was focused on being prepared for this trial as it was his first trial of this magnitude as a first term judge. He depended on his secretary to file the reports and between the time he gave her the reminder letters and the time she filed them they both had an extremely chaotic few weeks. He knows this is no excuse for his late filing, however he is requesting that the Board will waive this late fee or choose not to resurrect any old fees. If he is required to pay all of these fees, it will surely cause him a financial hardship. He assures this will not happen again because he has implemented a plan to take care of the filing of his reports from now on.

18:1505.4.A(1) Any candidate, the treasurer or chairman of a political committee, or any other person required to file any reports under this Chapter, who knowingly fails to file or who knowingly fails to timely file any such reports as are required by this Chapter may be assessed a civil penalty for each day until such report is filed.

18:1495.4D(1) If the final report of a candidate for an election, as required by Paragraph (5), (6), or (7)of Subsection B of this Section, shows a deficit or a surplus, the candidate and his treasurer, if any, shall file supplemental reports with the supervisory committee of all information required in R.S. 18:1495.5. Such reports shall be filed annually no later than February fifteenth and shall be complete through the preceding December thirty-first. Such a supplemental report shall be filed each year until a report has been filed which shows no deficit and until any surplus campaign funds have been disposed of in accordance with R.S. 18:1505.2(I). The report on surplus funds shall disclose the disbursement of such funds in the same manner as expenditures are reported.

Recommendations:
Decline to waive for both supplemental reports.
