Advisory opinion request regarding whether the Code of Governmental Ethics would prohibit Michael Sanders, the son of the Chairman of the Board for Fire District 1 in Natchitoches Parish, from being promoted to Fire Chief.
Facts:
Ricky Sanders has been the Chairman of the Board for District 1 for over a year. The Fire Chief recently quit and District 1 would like to promote his son, Michael Sanders, to the position. Michael Sanders has volunteered as a firefighter for District 1 for approximately 20 years and has served as Assistant Fire Chief the last eight months. All positions with District 1, including Fire Chief, are strictly volunteer with no compensation received.
Law:
La. R.S. 42:1119B provides that no member of the immediate family of a member of a governing authority or the chief executive of a governmental entity shall be employed by the governmental entity.

La. R.S. 42:1119C(6) provides a limited exception to La. R.S. 42:1119 and allows the employment of a volunteer firefighter and any decision regarding the employment of a volunteer firefighter by an agency head, a chief executive of a governmental entity, or a member of a governing authority.

La. R.S. 42:1112B(1) provides that no public servant shall participate in a transaction involving the governmental entity in which, to his actual knowledge, any member of his immediate family has a substantial economic interest.

Recommendations:
Adopt the proposed advisory opinion.
