Request for an Advisory Opinion from Angelique Williams relative to post-employment restrictions following her retirement from the Louisiana Department of Education - Division of Child Care Licensing as a Licensing Supervisor.
Facts:
Angelique Williams was employed by the Louisiana Department of Education as a Licensing Supervisor in the Division of Child Care Licensing until her retirement on December 31, 2018. As a Licensing Supervisor, Ms. Williams supervised 10 Licensing Specialists and her duties included the following:

  • Survey operations for statewide licensing of social care facilities to determine compliance with state and federal regulations;
  • Consult with administrators pertaining to internal and field procedures, policies and regulations;
  • Develop administrative and operational plans, policies and procedures;
  • Develop policies and procedures for Licensing Staff training;
  • Write updates and revisions to Licensing Field Procedure Manuals;
  • Conduct quarterly training with internal and field Licensing Staff.
While employed Ms. Williams did not provide staff training to license childcare providers nor did her duties require her to provide training to any external partners. While acting as a Licensing Specialist, Ms. Williams did offer suggestions on how to correct certain deficient practices, but she never provided training to any childcare center providers and staff.


Ms. Williams has been approached by the Louisiana Department of Health and Hospitals to become a Child Care Health Consultant. Her duties would include conducting staff training for licensed child care providers. As a Child Care Health Consultant, Ms. Williams would be paid directly by the provider and DHH's involvement would be providing a referral list of Certified Child Care Health Consultants to child care providers. The Child Care Health Consultant would provide training regarding specific health and safety topics such as food preparation, medication administration, sanitary practices, staff health, and children emotional and behavioral health.



Law:
La. R.S. 42:1121B(1) prohibits a former public employee, for a period of two years following the termination of his public employment, from assisting another person, for compensation, in a transaction, or in an appearance in connection with a transaction in which such former public employee participated at any time during his public employment and involving the governmental entity by which he was formerly employed, or for a period of two years following termination of his public employment, rendering, any service which such former public employee had rendered to the agency during the term of his public employment on a contractual basis, regardless of the parties to the contract, to, for, or on behalf of the agency with which he was formerly employed.
Recommendations:
