RE:
Request that the Board waive the $400 and $40 campaign finance late fees assessed against Jared "Boo" Bercegeay, a candidate for Member of School Board, District 6, Seat A, Ascension Parish, in the November 6, 2018 election, whose Special and 10-G campaign finance disclosure reports were filed 12 days and 1 day late, respectively.
Facts:
Jared Bercegeay states that this was his first ever campaign for District 6 School Board Member in the Parish of Ascension. Being a new candidate and misinformed by his peers, he states he did not realize a Special Report needed to be filed when receiving a loan from his own funds. He did however, report this loan of his personal funds on his 10-G report. He now has better knowledge of the process and will likely consider hiring a firm to help manage these campaign funds should he run again.

In reference to the 10-G report, Mr. Bercegeay states that on the evening of November 28th, 2018 he completed the 10-G Finance Disclosure Report and attempted to scan and file that night. However, due to technical problems with his printer/scanner he was unable to file the report that night. The next day he was able to use another machine to scan the report and successfully filed on November 29th, 2018, which was on day late.

Law:
18:1505.4.A(1) Any candidate, the treasurer or chairman of a political committee, or any other person required to file any reports under this Chapter, who knowingly fails to file or who knowingly fails to timely file any such reports as are required by this Chapter may be assessed a civil penalty for each day until such report is filed.

18:1495.4D(1) If the final report of a candidate for an election, as required by Paragraph (5), (6), or (7)of Subsection B of this Section, shows a deficit or a surplus, the candidate and his treasurer, if any, shall file supplemental reports with the supervisory committee of all information required in R.S. 18:1495.5. Such reports shall be filed annually no later than February fifteenth and shall be complete through the preceding December thirty-first. Such a supplemental report shall be filed each year until a report has been filed which shows no deficit and until any surplus campaign funds have been disposed of in accordance with R.S. 18:1505.2(I). The report on surplus funds shall disclose the disbursement of such funds in the same manner as expenditures are reported.

Recommendations:
Decline to waive for both the Special and 10-G reports.
