Advisory opinion request regarding Reflection of the Green Leaf Project, a 501(c)(3) non-profit corporation, collaborating with the East Baton Rouge Parish Drug Court as it relates to future grants.
Facts:
Daffaney J. Webster is currently employed as a registered nurse in the Eastern Louisiana Mental Health System within the Department of Health and Hospitals/Office of Behavioral Health. She works at the Forensic Aftercare Clinic in the Community Forensic Services Division which is located in New Orleans treating post-discharge forensic patients of Louisiana's state psychiatric hospitals.

Ms. Webster started a 501(c)(3) non-profit corporation, Reflection of the Green Leaf Project, whose purpose is to advocate on behalf of the mentally ill by decreasing barriers through the promotion of enrichment programs, development of resources, bridging gaps of communication, cultivating relationships, and integration into society. Reflection of the Green Leaf Project is considering collaborating with the 19th JDC Adult Drug Court Program as it relates to grants that it may receive in the future. The mission of the 19th JDC Adult Drug Court Program is to promote public safety by reducing drug and/or alcohol abuse or addiction and related criminal activity. The grants Ms. Webster will apply for will not involve her agency, the Community Forensic Services Division. However, Reflection of the Green Leaf Project may collaborate with entities that receive funding from the Office of Behavioral Health and apply for future grants through the Office of Behavioral Health.

Law:
La. R.S. 42:1113A(1)(a) states no public servant, or a member of such a public servant's immediate family, or a legal entity in which he has a controlling interest shall bid on or enter into any contract, subcontract or other transaction that is under the supervision or jurisdiction of the agency of such public servant.
Recommendations:
Adopt the proposed advisory opinion.
