Advisory opinion request regarding whether the Code of Governmental Ethics would prohibit Roger Freeman, the elected Police Chief for the Town of Many, from being employed as a School Resource Officer (SRO) in Sabine Parish schools.
Facts:
Roger Freeman is the elected Police Chief for the Town of Many located in Sabine Parish which is governed by the Lawrason Act. The Sabine Parish School Board has been in negotiations with the Sheriff of Sabine Parish about the possibility of expanding the SRO program in Sabine Parish schools. Chief Freeman has an opportunity to be employed by the Sabine Parish Sheriff's Department as a SRO to work at schools located outside of his elected municipal city limits during regular school hours while he continues to serve as Police Chief for the Town of Many. As Police Chief, Chief Freeman is on call twenty-four hours per day. If he is required to leave his post as a SRO during the school day to handle a police matter for the Town of Many, it is understood that he will not be compensated by the Sheriff for the time away from school.
Law:
La. R.S. 42:1111A(1)(a) provides that no public servant shall receive anything of economic value, other than compensation and benefits from the governmental entity to which he is duly entitled, for the performance of the duties and responsibilities of his office or position.
Recommendations:
Adopt the proposed advisory opinion.
