RE:
Advisory opinion request regarding whether a Type 1 Charter School's application submitted to the Vermilion Parish School Board that includes people in positions prohibited by R.S. 42:1119 renders the application null and void and whether such deficiencies can be cured without starting the charter application process over.
Facts:
A Type 1 Charter School has filed an application for a charter with the Vermilion Parish school Board that contains individuals in positions that would be prohibited by La. R.S. 42:1119.
Law:
La. R.S. 17:3996B(20) provides that charter school's officers and employees are subject to the Code of Ethics.

La. R.S. 42:1119B provides no member of the immediate family of a member of a governing authority or the chief executive of a governmental entity shall be employed by the governmental entity.
La. R.S. 42:1119B(2)(a)(i) permits the school board to employ an immediate family member of a school board member, provided the family member is certified to teach and teaching in a classroom.

Recommendations:
Adopt proposed advisory opinion.
