An advisory opinion request, submitted by Dwight Norton, regarding whether he or his company (Umbrella Collaborative, L3C) would be prohibited from entering into a direct contractual relationship with the City of New Orleans Office of Homeland Security and Emergency Preparedness ("NOHSEP") to provide community engagement consulting services to support the development of an updated FEMA Hazard Mitigation Plan.
Facts:
Mr. Norton was employed by the City of New Orleans officially as an Urban Environmental Planner from August 29, 2016 until January 25, 2019. His position was also known as an Urban Mobility Coordinator for the Office of Resilience and Sustainability, which was a division of the Chief Administrative Office. As an Urban Environmental Planner/ Urban Mobility Coordinator, Mr. Norton's job tasks included developing, coordinating, and implementing transportation policies and programs for the Office of Resilience and Sustainability. While he collaborated with other colleagues in the Office of Resilience and Sustainability, he did not supervise anyone or have anyone directly report to him during his employment at the City of New Orleans. Furthermore, Mr. Norton was not an agency head, elected official, or a member of a board or commission.
Law:
La. R.S. 42:1121B provides no former public employee shall, for a period of two years following the termination of his public employment, assist another person, for compensation, in a transaction, or in an appearance in connection with a transaction in which such former public employee participated at any time during his public employment and involving the governmental entity by which he was formerly employed, or for a period of two years following the termination of his public employment, render, any service which such former public employee had rendered to the agency during the term of his public employment on a contractual basis, regardless of the parties to the contract, to, for, or on behalf of the agency with which he was formerly employed.
Recommendations:
Adopt the proposed opinion.
