An advisory opinion request, submitted by Jared Genova, regarding whether he or his company (Umbrella Collaborative, L3C) would be prohibited from entering into a direct contractual relationship with the City of New Orleans Office of Homeland Security and Emergency Preparedness ("NOHSEP") to provide community engagement consulting services to support the development of an updated FEMA Hazard Mitigation Plan.
Facts:
Mr. Genova was employed by the City of New Orleans officially as a Contract Specialist - Resilience for the Project Delivery Unit from October 10, 2016 until May 4, 2018. The Project Delivery Unit operated under the Office of Resilience and Sustainability, which was a division of the Chief Administrative Office. As a Contract Specialist, Mr. Genova's job tasks included grants compliance for HUD CDBG-NDR grants and the development of "HUD Action Plan" Strategies for the implementation of CDBG-NDR funded projects. Mr. Genova did not supervise or manage anyone. Furthermore, Mr. Genova was not an agency head, elected official, or a member of a board or commission.
Law:
La. R.S. 42:1121B provides no former public employee shall, for a period of two years following the termination of his public employment, assist another person, for compensation, in a transaction, or in an appearance in connection with a transaction in which such former public employee participated at any time during his public employment and involving the governmental entity by which he was formerly employed, or for a period of two years following the termination of his public employment, render, any service which such former public employee had rendered to the agency during the term of his public employment on a contractual basis, regardless of the parties to the contract, to, for, or on behalf of the agency with which he was formerly employed.

Recommendations:
Adopt the proposed opinion.
