An advisory opinion request, submitted by Mandy Green, Ph.D. ("Dr. Green"), regarding whether she would be prohibited from accepting employment from Royal Engineers & Consultants after terminating her employment with the State of Louisiana Coastal Protection and Restoration Authority ("CPRA").
Facts:
Dr. Green has been employed by CPRA since May 2005, which is separated into five (5) divisions: Executive, Engineering, Operations, Planning and Research, and Project Management. Dr. Green is currently employed by CPRA as a Coastal Resources Scientist Senior - DCL B in the Planning and Research Division and has been since August 2015. While in her current position, Dr. Green has performed duties as: 1) Team Member for development of Louisiana's Comprehensive Coastal Management Master Plan; 2) Team Member for development of the Flood Risk and Resilience Program; and, 3) Contract Monitor for Environmental Science and Consulting Services ("ESCS") contracts.
Dr. Green is considering employment with Royal Engineers & Consultants ("REC"), which is a private engineering and environmental consulting company. REC currently holds an ESCS contract with CPRA, for which Dr. Green previously served as Contract Monitor.
Law:
La. R.S. 42:1121B provides no former public employee shall, for a period of two years following the termination of his public employment, assist another person, for compensation, in a transaction, or in an appearance in connection with a transaction in which such former public employee participated at any time during his public employment and involving the governmental entity by which he was formerly employed, or for a period of two years following the termination of his public employment, render, any service which such former public employee had rendered to the agency during the term of his public employment on a contractual basis, regardless of the parties to the contract, to, for, or on behalf of the agency with which he was formerly employed.
Recommendations:
Adopt the proposed opinion.
