RE:
Request that the Board reconsider the reassessment of the $2,200 suspended campaign finance late fee assessed against Troy A. Carter, Sr., a candidate for Mayor, Orleans Parish, in the February 2, 2002 election, whose 2017 Supplemental campaign finance disclosure report was filed 187 days late.
Facts:
INITIAL REQUEST: Senator Troy Anthony Carter, Sr. states that according to Gene Dawson, while employed by the Ethics Board, told him that if there was no activity on the account no report needed to be filed. Consequently, he states that he did not know that his election in 2017 had a report that had to be filed with 2002's information on it. Additionally, he states Hurricane Katrina affected the New Orleans area and his staff members that dealt with his official mail and were displaced for an elongated period of time. It would be greatly appreciated if the Board would consider a full waiver.

RECONSIDERATION: Sen. Troy Carter stated that he gave to his assistant the task of paying the $300 late fee. However, during this time, his assistant was having medical issues, including mini strokes. Since the Board's consideration of the matter she is no longer able to work.

ACTION OF BOARD: At September 21, 2018 meeting, the Board suspended all but $300 of the $2,500 based on payment of the $300 in 30 days and future compliance with the reporting provisions.


Law:
18:1505.4.A(1) Any candidate, the treasurer or chairman of a political committee, or any other person required to file any reports under this Chapter, who knowingly fails to file or who knowingly fails to timely file any such reports as are required by this Chapter may be assessed a civil penalty for each day until such report is filed.

18:1495.4D(1) If the final report of a candidate for an election, as required by Paragraph (5), (6), or (7)of Subsection B of this Section, shows a deficit or a surplus, the candidate and his treasurer, if any, shall file supplemental reports with the supervisory committee of all information required in R.S. 18:1495.5. Such reports shall be filed annually no later than February fifteenth and shall be complete through the preceding December thirty-first. Such a supplemental report shall be filed each year until a report has been filed which shows no deficit and until any surplus campaign funds have been disposed of in accordance with R.S. 18:1505.2(I). The report on surplus funds shall disclose the disbursement of such funds in the same manner as expenditures are reported.

Recommendations:
Do not reassess the $2,200 suspended amount; however, advise Sen. Carter that if he is late filing a campaign finance report in the future, the $2,200 will be immediately due and owing.
