RE:
Request for an advisory opinion from the St. Charles Parish Sheriff's Office whether the agency could award employees through a drawing held for employees who document certain healthy practices. St. Charles Parish has a population of 52,812.
Facts:
St. Charles Parish Sheriff, Greg Champagne, would like to encourage his employees to have annual physicals, exercise regularly and engage in healthy practices in order to have healthier, more fit employees to better serve the public and reduce health insurance expenses to save public dollars.

In order to encourage his employees, the Sheriff would like to implement an award system having employees document certain healthy practices and in return would receive points toward a drawing to be held periodically. Prizes would be awarded to employees drawn in the form of a "fit bit" or other item to promote healthy living.

Law:
La. R.S. 42:1111A(1)(a) prohibits a public servant from receiving anything of economic value, other than compensation and benefits from the governmental entity to which he is duly entitled, for the performance of the duties and responsibilities of his office or position.
Recommendations:
Adopt the proposed advisory opinion draft.
Assigned Attorney: Greg Thibodeaux
