RE:
Request for an advisory opinion from Rose Gilbert, Chairperson of the Jefferson Parish Human Services Authority Board of Directors as to whether her formation of Lifeline Advocacy would violate the Code of Governmental Ethics.
Facts:
Rose Gilbert is Chairperson of the Board of the Jefferson Parish Human Services Authority ("JPHSA"), an agency that provides primary care and behavioral health services and supports and serves individuals with special needs in Jefferson Parish. Ms. Gilbert recently founded Lifeline Advocacy, a for profit agency whose purpose is to assist individuals and families to access and obtain the services needed. Unlike JPHSA, Lifeline Advocacy's mission and scope of work does not include seeking or managing funding for resource and service development, or funding management necessary for resource allocation to individuals in need of services. Lifeline Advocacy will not provide any community services and supports, therapies, or specialized services which are provided by JPHSA.
Law:
La. R.S. 42:1111C(1)(a) prohibits a public servant from receiving any thing of economic value for any service, the subject matter of which is devoted substantially to the responsibilities, programs, or operations of the agency of the public servant and in which the public servant has participated.
Recommendations:
Adopt the proposed advisory opinion draft.
