| An advisory opinion request, submitted by Sylvia Manuel, regarding whether the Code would prohibit Josey Briscoe ("Ms. Briscoe") from serving as site manager of the Basile Property while her mother, Rebekah Bertrand ("Ms. Bertrand"), is employed as an Assistant with the Kinder Public Housing Authority ("KPHA"). |

Ms. Manuel, as the Executive Director, is the agency head of the KPHA and she reports directly to the Board of Directors. For the past nineteen (19) years, Ms. Bertrand has been employed as Ms. Manuel's Assistant. Ms. Bertrand does not possess any hiring or firing authority, does not sign any checks, and reports directly to Ms. Manuel.
The Elton, Oberlin, and Basile Housing Authorities will soon be merging with KPHA. For the past five (5) years, Ms. Briscoe has served as the Site Manager for the Basile Housing Authority ("BHA") and will be the BHA Site Manager once the merger is complete. Additionally, once the merger is complete, Ms. Briscoe will report to Ms. Manuel.

La. R.S. 42:1119A states that no member of the immediate family of an agency head shall be employed in his agency.
La. R.S. 42:1119B provides no member of the immediate family of a member of a governing authority or the chief executive of a governmental entity shall be employed by the governmental entity.
