RE:
Request for an advisory opinion from Blake Guidry, a former engineer with the Louisiana Department of Transportation and Development relative to post-employment restrictions.
Facts:
Blake Guidry was employed by the Louisiana Department of Transportation and Development ("DOTD") as an engineer until July 2019. Mr. Guidry was assigned to District 61 Project Engineer's Office, Gang 266, where he served as the Project Engineer DOTD Engineer 6. As Project Engineer, Mr. Guidry managed state construction projects in parts of East Baton Rouge Parish. Mr. Guidry's duties included construction management, contract administration, site durvey, and material quality assurance for projects through Gang 266 only.

Mr. Guidry began working for ECM Consultants ("ECM") in July 2019. ECM provides design work and construction inspection and engineering services. ECM currently has a contract with DOTD District 61 providing construction engineering and inspection when necessary. Mr. Guidry would like to be able to assist ECM on projects within District 61, but outside of Gang 266.


Law:
La. R.S. 42:1121B(1) prohibits a former public employee, for a period of two years following the termination of his public employment, from assisting another person, for compensation, in a transaction, or in an appearance in connection with a transaction in which such former public employee participated at any time during his public employment and involving the governmental entity by which he was formerly employed, or for a period of two years following termination of his public employment, rendering, any service which such former public employee had rendered to the agency during the term of his public employment on a contractual basis, regardless of the parties to the contract, to, for, or on behalf of the agency with which he was formerly employed.
Recommendations:
Adopt the proposed draft advisory opinion.
