Request that the Board waive a $360 campaign finance late fee assessed against Tammy Dabadie, a candidate for Member of School Board, District 6, East Baton Rouge Parish, in the November 6, 2018, election, whose 10-G campaign finance disclosure report was filed 6 days late.
Facts:
Tammy Dabadie states that this is her first time running for public office. She qualified to run for office and 3 weeks later she withdrew. However, she was under the impression that because her name would not come off the ballot that she did not need to officially withdraw. She no longer had a campaign manager or anyone connected to her campaign to inform her of the things that still needed to be done since she was still officially in the race.

She states that she did fill out the 30-P report but was late doing so because she did not attach it correctly and found it extremely difficult to figure out which forms went with each deadline. She has since figured this out and paid the $120 late fee. She states that since she was in the primary and not the general election she did not think she had to submit a 10-G report.

Finally, she stated that she had emergency retinal detachment surgery to reattach her retina. Having the gas bubble fully evaporate in her eye over the course of two months has caused a cataract which is typical after retina surgery. She is now legally blind in her eye until cataract surgery can be performed in February.

18:1505.4.A(1) Any candidate, the treasurer or chairman of a political committee, or any other person required to file any reports under this Chapter, who knowingly fails to file or who knowingly fails to timely file any such reports as are required by this Chapter may be assessed a civil penalty for each day until such report is filed.

18:1495.4D(1) If the final report of a candidate for an election, as required by Paragraph (5), (6), or (7)of Subsection B of this Section, shows a deficit or a surplus, the candidate and his treasurer, if any, shall file supplemental reports with the supervisory committee of all information required in R.S. 18:1495.5. Such reports shall be filed annually no later than February fifteenth and shall be complete through the preceding December thirty-first. Such a supplemental report shall be filed each year until a report has been filed which shows no deficit and until any surplus campaign funds have been disposed of in accordance with R.S. 18:1505.2(I). The report on surplus funds shall disclose the disbursement of such funds in the same manner as expenditures are reported.

Recommendations:
Waive the late fee.
