Advisory opinion request from Tobias Mroch regarding whether or not his company may contract or subcontract to provide services to his former employer, LSU.
Facts:
Mr. Mroch resigned from his position as an estimator/planner for the Planning, Design & Construction Department at LSU on June 28, 2019, and previously worked for the University as an electrician master with Residential Life Facility Maintenance from April 28, 2013 through May 30, 2015. There was no break in service between the two positions. During his tenure as an electrician master he conducted electrical maintenance repair. As an estimator/planner he met with professors and other customers to provide estimates for renovation projects. His company, Sergeant Electric, LLC, is seeking to contract both directly with LSU and through a subcontractor to provide electrical construction project services such as adding circuits and upgrading lighting and other electrical systems during renovation projects. Sergeant Electric, LLC, would provide a quote for electrical services based off their scope of work and, if hired, provide those services on a project-to-project basis.
Law:
La. R.S. 42:1121B provides no former public employee shall, for a period of two years following the termination of his public employment, assist another person, for compensation, in a transaction, or in an appearance in connection with a transaction in which such former public employee participated at any time during his public employment and involving the governmental entity by which he was formerly employed, or for a period of two years following the termination of his public employment, render, any service which such former public employee had rendered to the agency during the term of his public employment on a contractual basis, regardless of the parties to the contract, to, for, or on behalf of the agency with which he was formerly employed
Recommendations:
Adopt the proposed opinion.
