Waiver request submitted by Cindy Langton Manasco, Assessor, Sabine Parish, regarding a $1100.00 late fee assessed for filing her amended 2017 Tier 2 annual pfd 11 days late.
Facts:
The late fee order was sent via Subpoena on 2/15/2019. Ms. Manasco filed a waiver on 4/1/2019. It took staff until 8/9/2019 to receive the signed subpoena return.

Ms. Manasco is asking for a waiver. She thought she filed her Tier 2 timely; however, there was an error. During the time she was notified of the failure to file, her husband passed away of a heart attack. Due to the devastating impact of his death, she overlooked and neglected to amend the report within the time frame she was given.

According to our records, her report was uploaded blank on 5/16/18 and an NOD- amend was sent. The NOD was received on 11/29/2018 and her husband passed away on November 2, 2018.

Law:
La. R.S. 42:1124.2 requires each person holding a public office who represents a voting district having a population of 5,000 or more persons to file an annual personal financial disclosure statement on or before May 15th of each year during which the person holds office and the year following termination of the holding of such office.

La. R.S. 42:1124.4 of the Code provides that upon discovery of the failure to file, failure to timely file, omission of information or inaccurate information, the Board shall notify the filer by sending him a notice of delinquency by certified mail. The notice of delinquency shall inform the person that the financial statement must be filed, or that the information must be disclosed or accurately disclosed, or that a written answer contesting the allegation of such failure, omission, or inaccuracy must be filed no later than seven (7) business days after receipt of the notice of delinquency.

Recommendations:
Suspend all based on future compliance with the reporting requirements under the Code of Ethics.
