Waiver request submitted by Joseph W. Lockett Sr., City Marshal, City Court, City of Oakdale, Allen Parish (Pop. 7,780), regarding a $2500.00 late fee assessed for filing his amended 2016 Tier 2 annual pfd 357 days late.
Facts:
Mr. Lockett is requesting a waiver as he thought he filed his 2016 amendment in July of 2016 (however that appears to be for his 2015 Tier 2 Election Candidate Report.) He states he does not go out of his way to not file reports and he makes less than a Wal-Mart employee and does not have the money to pay the fine.

Tammy and Tracy met with Mr. Lockett on July 2nd going over all the PFD late fees. Staff advised him to submit a waiver request letter immediately. He was also advised of a $2000.00 campaign finance fee that is outstanding and he would need to request a waiver once served.

Law:
La. R.S. 42:1124.2 requires each person holding a public office who represents a voting district having a population of 5,000 or more persons to file an annual personal financial disclosure statement on or before May 15th of each year during which the person holds office and the year following termination of the holding of such office.

La. R.S. 42:1124.4 of the Code provides that upon discovery of the failure to file, failure to timely file, omission of information or inaccurate information, the Board shall notify the filer by sending him a notice of delinquency by certified mail. The notice of delinquency shall inform the person that the financial statement must be filed, or that the information must be disclosed or accurately disclosed, or that a written answer contesting the allegation of such failure, omission, or inaccuracy must be filed no later than seven (7) business days after receipt of the notice of delinquency.
