Consent opinion regarding Roy Austin d/b/a Austin Sales and Service, Inc. receiving compensation for private security services that were not actually performed, at a time when Mr. Austin was employed with the Orleans Parish Sheriff's Office.
Facts:
From 2010 to 2015, Roy Austin used Sheriff's Office computers, equipment and supplies to coordinate off-duty details to be performed by Sheriff's deputies for different functions and events. Roy Austin d/b/a Austin Sales and Service, Inc. received compensation for private security services that were not actually performed, at a time when Mr. Austin was employed with the Orleans Parish Sheriff's Office.

The Board agreed to settle the matter with a joint consent opinion with a civil penalty of $1,000. Mr. Austin has signed the joint consent opinion and paid the $1,000 civil penalty.
Law:
La. R.S. 42:1111C(2) prohibits a public servant and a legal entity in which the public servant exercises control or owns an interest in excess of twenty-five percent, from receiving any thing of economic value for or in consideration of services rendered, or to be rendered, to or for any person during his public service unless such services are: (a) Bona fide and actually performed by the public servant or by the entity; (b) Not within the course of his official duties; (c) Not prohibited by R.S. 42:1112 or by applicable laws or regulations governing nonpublic employment for such public servant.

La. R.S. 42:1112A prohibits a public servant, except as provided in R.S. 42:1120, from participating in a transaction in which he has a personal substantial economic interest of which he may be reasonably expected to know involving the governmental entity.

Recommendations:
Adopt and publish the consent opinion and dismiss charges.
