Advisory Opinion request from Gonzales Middle School (Ascension Parish) teacher Carla Babin regarding ordering shirts for her students.
Facts:
Carla Babin is a teacher at Gonzales Middle School (GMS) in Ascension Parish who has previously ordered personal shirts from The Spirit Stick, an apparel business owned by Jerry Binder, husband of fellow Gonzales Middle teacher Jamie Binder. Ms. Babin now is seeking clarification as to whether she may order school-themed shirts for her students from The Spirit Stick for events such as spirit days or graduation. Each student would individually pay for the cost of a shirt and none of Ms. Babin's students are taught by Mrs. Binder. The GMS principal would approve the shirt's design and the money would be collected by a school employee after order forms were completed by the interested students.
Law:
La. R.S. 42:1113A(1)(a) states no public servant, excluding any legislator and any appointed member of any board of commission and any member of a governing authority of a parish with a population of ten thousand or less, or member of such a public servant's immediate family, or legal entity in which he has a controlling interest shall bid on or enter into any contract, subcontract, or other transaction that is under the supervision or jurisdiction of the agency of such public servant.

Recommendations:
Adopt the proposed opinion.
