Advisory opinion regarding whether advisory members of the First Planning District Workforce Development Board are required to file Tier 2.1 annual personal financial disclosure statements pursuant to La. R.S. 42:1124.2.1 and take the annual Ethics training pursuant to La. R.S. 42:1170.
Facts:
Tthe First Planning District Workforce Development Board was created in compliance with the Workforce Innovation and Opportunity Act (WIOA) of 2014. The First Planning District Workforce Development Board provides administration of workforce development activities and execution of WIOA funds allocated from the U.S. Department of Labor through the State.
The First Planning District Workforce Development Board recognizes the value and importance of involving external stakeholders in the development, delivery, and promotion of your programs and required functions. Therefore, the First Planning District Workforce Development Board seeks to appoint Advisory Board members to the First Planning District Workforce Development Board that will represent a cross section of business, education, government and partner agencies within the tri-parish area not already represented on the board. The Advisory Board members will be non-voting and will not engage in decision-making related to official board business.
Law:
La. R.S. 42:1124.2.1 requires financial disclosure for each member and designee of a board or commission which has the authority to expend, disburse or invest $10,000 or more of funds in a fiscal year on or before May 15th of each year during which the person holds office and the year following termination of the holding of such office.
Ethics Board Docket No. 2009-356 - The Board determined that the members of the First Planning District Workforce Development Board are required to file Personal Financial Disclosure Statements pursuant to La. R.S. 42:1124.2.1.
La. R.S. 42:1170A(3)(a)(i) Commencing on January 1, 2012, each public servant shall receive a minimum of one hour of education and training on the Code of Governmental Ethics during each year of his public employment or term of office as the case may be.
Recommendations:
Adopt proposed advisory opinion.
