Advisory Opinion request from Johnny Ray Carpenter, Chief of Police, City of Winnfield regarding the hiring of Angie Curry.
Facts:
Charles Curry is currently employed by the Winnfield Police Department as a Lieutenant. Mr. Curry's duties include training, fleet management, and logistics. His duties do not include participation in personnel decisions, such as hiring, evaluations, merit increases, promotions, and disciplinary actions. Mr. Curry is not a supervisor of communications officers.

Any personnel decisions regarding Angie Curry would be made by Mr. Carpenter as Chief of Police.

Law:
La. R.S. 42:1119A provides that no member of the immediate family of an agency head shall be employed in his agency.
La. R.S. 42:1102(3) defines "agency head" as the chief executive or administrative officer of an agency.

La. R.S. 42:1112B(1) prohibits a public servant from participating in any transaction involving the governmental entity, in which any member of his immediate family has a substantial economic interest.

Nos. 2009-1084 and 2012-187, the Board concluded that Angie Curry would not be prohibited from being hired by the Winnfield Police Department, since her husband, Charles Curry, is not an agency head over the Winnfield Police Department.

Recommendations:
Adopt the proposed advisory opinion.
