Request for an advisory opinion from Brett LeBlanc relative to post employment restrictions following his retirement from the Louisiana Department of Environmental Quality.
Facts:
Brett LeBlanc has been employed with the Louisiana Department of Environmental Quality ("LDEQ") since 1987. From 1987 until 2012, Mr. LeBlanc worked as a Geologist handling solid and hazardous waste permit applications, groundwater monitoring, and overseeing contamination from chemical plants and pipeline spills. From 2012 until his anticipated retirement at the end of 2019, Mr. LeBlanc has worked as an Environmental Scientist in the Underground Storage Tank Division ("UST") for the Acadiana Region (Lafayette). Mr. LeBlanc's duties included compliance inspections of UST sites and conducted installation and closure inspection of UST sites in the Acadiana area. Mr. LeBlanc had no supervisory duties as an Environmental Scientist. At no time during his tenure with LDEQ did Mr. LeBlanc work on any legacy lawsuits.
Law:
La. R.S. 42:1121B(1) prohibits a former public employee, for a period of two years following the termination of his public employment, from assisting another person, for compensation, in a transaction, or in an appearance in connection with a transaction in which such former public employee participated at any time during his public employment and involving the governmental entity by which he was formerly employed, or for a period of two years following termination of his public employment, rendering, any service which such former public employee had rendered to the agency during the term of his public employment on a contractual basis, regardless of the parties to the contract, to, for, or on behalf of the agency with which he was formerly employed.
Recommendations:
Adopt the proposed draft of an advisory opinion.
