Request that the Board waive the $200 campaign finance late fees assessed against New Orleans Hospitality Coalition PAC, Inc., a political action committee, its committee's chairperson, Terry Epton, and treasurer, Dickie Brennan, for the June 2019 Monthly campaign finance report that was filed 1 day late.
Facts:
Tammie Boteler, NOHCP AC Administrator & Financial Services New Orleans Hospitality Coalition PAC, Inc., would like to request that the Board of Ethics dismiss the late fee assessment for the June 2019 monthly report due to the fact that their office was inaccessible because of street flooding. They were forced to close their offices therefore; unable to access the needed records to file the monthly report as scheduled. They immediately contacted the Campaign Finance Office the next day to notify them of their delinquency and situation. Please consider their request due to circumstances beyond thier control and also for having a perfect track record of never filing delinquent in past years.

Law:
18:1505.4.A(1) Any candidate, the treasurer or chairman of a political committee, or any other person required to file any reports under this Chapter, who knowingly fails to file or who knowingly fails to timely file any such reports as are required by this Chapter may be assessed a civil penalty for each day until such report is filed. 18:1484.(2)(b). Each candidate for any other public office shall file reports of contributions in excess of two hundred dollars in the aggregate during the aggregating period.

Rule 1205B(3) provides that an automatic late fee shall be rescinded by the staff, if the person required to file the report did not file the report due to a natural disaster, an act of God, force majeure, a catastrophe, or such other similar occurrence, which occurred on the due date or during the seven days prior to the date the report was due.


Recommendations:
Rescind the late fee pursuant to Rule 1205B(3).
