Brian North is employed as an Electronic Technician Advanced with the Louisiana Department of Transportation and Development ("DOTD"), Gang 752, District 4. Jacob North is the son of Brian North and was recently selected to fill a position as an Electronic Technician Trainee with DOTD, Gang 752, District 4. Brian North has functional supervision only over Jacob North, with Shawn Ray, Electronic Technician Supervisory having supervisory authority. DOTD submitted a disqualification plan whereby Shawn Ray, Electronic Technician Supervisor will be responsible for supervision of Jacob North, including approval of duties, pay, performance evaluation, promotion, and any decision which involves a potential substantial economic interest for Jacob North. Further, Brian North shall recuse himself from any decisions involving Jacob North's pay, performance evaluation, promotion, or any decision which involves a potential substantial economic interest for Jacob North.

La. R.S. 42:1112B(1) prohibits a public servant from participating in a transaction involving the governmental entity in which, to his actual knowledge, any member of his immediate family has a substantial economic interest.
La. R.S. 42:1112C provides that every public employee, excluding an appointed member of any board or commission, shall disqualify himself from participating in a transaction involving the governmental entity when a violation of this Part would result.
