Waiver request submitted by Ana Margaret Perez, former member of the Virtual Academy of Lafourche, regarding a $1450 late fee assessed for filing her 2018 Tier 3 annual pfd 29 days late.
Facts:
Mrs. Perez stated as follows:


Mrs. Perez is requesting a waiver for the untimely filing of her 2018 Tier 3 PFD. Mrs. Perez stated she is a stay home mother of four and served as a non paid volunteer for the Virtual Academy of Lafourche; This fine would be a "financial constraint" on her family.

Mrs. Perez stated during the fall of 2017 she became very ill. After seeing 3 doctors, she was diagnosed with Chronic Autoimmune Disease (Antisynthetase Syndrome), Ulcerative Colitis and suffers from inflammation and pain each day. She included 3 letters from Thibodaux Regional doctors whom care she was under from Fall of 2017 through Spring of 2018.

Due to her health issues, Mrs. Perez verbally resigned from the board and stopped attending the meetings in 2017. She was not informed she needed to submit her resignation in written form until 2018. On June 11, Mrs. Perez submitted her written resignation. Mrs. Perez also stated there was a "serious miscommunication" between the academy and herself. Ever since starting on the board, she always filled out her Tier 3 at a board meeting and the administrative staff member at Virtue would be in charge of submitting the forms to the state. Mrs. Perez said that no one ever informed her she had to complete a 2018 PFD, nor contacted her regarding it. Mrs. Perez "humbly asks" that the board wave this late fee.

Law:
La. R.S. 42:1124.3 requires persons holding a public office who represent a voting district having a population of less than 5,000 and each member of the governing authority or management board of a charter school created pursuant to Chapter 42 of Title 17 of the Louisiana Revised Statutes of 1950 to file a financial disclosure statement on or before May 15th of each year during which the person holds office and the year following termination of the holding of such office.

La. R.S. 42:1124.4 of the Code provides that upon discovery of the failure to file, failure to timely file, omission of information or inaccurate information, the Board shall notify the filer by sending him a notice of delinquency by certified mail. The notice of delinquency shall inform the person that the financial statement must be filed, or that the information must be disclosed or accurately disclosed, or that a written answer contesting the allegation of such failure, omission, or inaccuracy must be filed no later than seven (7) business days after receipt of the notice of delinquency.

Recommendations:
Suspend all based on future compliance with the reporting requirements under the Code of Ethics.
