Advisory Opinion request submitted by Darrell Montgomery regarding private sector post-employment options after retiring from the Louisiana Department of Health.
Facts:
At the time of his request, Mr. Montgomery stated that he is a clinical social worker with the Louisiana Department of Health's Office of Behavioral Health who intended to retire on September 30, 2019. He began his employment with LDH in September 1998 and held a variety of positions during his continuous service. He is interested in returning to the private sector to work in health care and is seeking guidance as to what limitations may exist while pursuing post-retirement employment options, but does not currently have an offer of employment about which he is seeking clarification.
Law:
La. R.S. 42:1121B provides no former public employee shall, for a period of two years following the termination of his public employment, assist another person, for compensation, in a transaction, or in an appearance in connection with a transaction in which such former public employee participated at any time during his public employment and involving the governmental entity by which he was formerly employed, or for a period of two years following the termination of his public employment, render, any service which such former public employee had rendered to the agency during the term of his public employment on a contractual basis, regardless of the parties to the contract, to, for, or on behalf of the agency with which he was formerly employed.

Recommendations:
Adopt the proposed opinion.
