Advisory Opinion request submitted by Jon K. Guice on behalf of the Evangeline Parish School Board, regarding the limitations on the employment of an immediate family member of a school principal as a classroom teacher in the principal's school.
Facts:
Requesting party stated that Evangeline Parish has a population of 33,984 according to the latest decennial census and that the EPSB is experiencing difficulty recruiting and hiring certified teachers. He posed three questions related to the employment of an immediate family member of a principal: (1) whether such an immediate family member may be employed as a certified classroom teacher at the principal's school; (2) whether such employment could take place if a disqualification plan is submitted to the Board for review and approval; and, (3) whether the criteria and limitations set forth in an attached policy would be sufficient to allow the continued employment of a principal's immediate family member.

Law:
La. R.S. 42:1119B(2)(a)(i) permits the school board to employ an immediate family member of a school board member, provided the family member is certified to teach and teaching in a classroom.

La. R.S. 42:1119C(2) provides that the provisions of this Section shall not prohibit the continued employment of any public employee nor shall it be construed to hinder, alter, or in any way affect normal promotional advancements for such public employee where a member of public employee's immediate family becomes the agency head of such public employee's agency, provided that such public employee has been employed in the agency for a period of at least one year prior to the member of the public employee's immediate family becoming the agency head.



Recommendations:
Adopt the proposed opinion.
