Advisory Opinion request from Emmy O'Dwyer, employed by the Louisiana Department of Education, whether she could sit as a Board Member for Abeona House Child Discovery Center in New Orleans.
Facts:
Emmy O'Dwyer has been employed by the Louisiana Department of Education ("DOE") as an Educational Program Consultant 4 through the Office of Policy and Analytics on the Early Childhood Strategy team since November 2017. Prior to her employment with the DOE, Ms. O'Dwyer served as Executive Director of Abeona House Child Discovery Center, an early learning center licensed by the state of Louisiana and located in New Orleans. As an Educational Program Consultant, Ms. O'Dwyer works with early learning centers to strengthen their business, administrative, and instructional practices. This is accomplished through initiatives to promote professional development and pilot programs to enhance business practices.

Ms. O'Dwyer would like to serve as a Board Member of Abeona House Child Discovery, a non-compensated position. As a Board Member, Ms. O'Dwyer would be responsible for fund raising, expansion, and long-term planning of the Abeona House Child Discovery Center.

Ms. O'Dwyer plans to remain employed with the DOE and her duties as a Board Member would be handled outside her hours employed with the DOE.


Law:
La. R.S. 42:1111C(1)(a) prohibits a public servant from receiving any thing of economic value for any service, the subject matter of which is devoted substantially to the responsibilities, programs, or operations of the agency of the public servant and in which the public servant has participated.

La. R.S. 42:1112B(3) prohibits a public servant from participating in a transaction involving the governmental entity in which, to his actual knowledge, any person of which he is an officer, director, trustee, partner, or employee has a substantial economic interest.
