Advisory Opinion request submitted by the Sabine Parish Police Jury regarding hiring a father and son as superintendent and assistant superintendent of the parish landfill.
Facts:
The Sabine Parish Police Jury will soon be resuming operation of the Sabine Parish Landfill, which has been managed for the past 25 years by a contractor, Louisiana Regional Landfill Company (LRLC). The parish expects to begin operation of the landfill on March 1, 2020 and is resuming its operation due to the inability to reach an agreement with LRLC on fees for continued operation. SPPJ would like to hire Mr. Peter Chreene and his son, Mr. Nick Chreene, to work at the landfill as superintendent and assistant superintendent, respectively. Peter Chreene previously worked as the landfill superintendent for LRLC for 15 years and Nick Chreene worked as a lead operator for seven and one-half years.
Law:
La. R.S. 42:1119A states that no member of the immediate family of an agency head shall be employed in his agency.

La. R.S. 42:1102(3) defines "agency head" to mean the chief executive or administrative officer of an agency or any member of a board or commission who exercises supervision over the agency.

La. R.S. 42:1102(13) defines "immediate family" as the term relates to a public servant to mean his children, the spouses of his children, his brothers and their spouses, his sisters and their spouses, his parents, his spouse, and the parents of his spouse.

Recommendations:
Adopt the proposed opinion.
