Request for an advisory opinion by Chris Cagnolatti, a Probation and Parole Officer in the Tallulah (pop. 7,335) District Office, concerning whether his wife, Pam Cagnaolatti, can provide services as a sex offender counselor.
Facts:
Chris Cagnolatti is currently employed with the Louisiana Department of Corrections, Division of Probation and Parole, and works in the Tallulah District Office of Probation and Parole. One of the duties of a Probation and Parole Officer is to supervise sex offenders and monitor that they attend monthly counseling.

Parolees are supervised by the Office of Probation and Parole and pay monthly supervision fees.


Mr. Cagnolatti's wife, Pam Cagnolatti, is a licensed, certified sex counselor and would like to counsel clients who are supervised by the Division of Probation and Parole. She would be compensated for her services.


Individual parolees determine who they will use as a sex offender counselor. Parolees are provided with a list of counselors to choose from. The list is generated by the Office of Probation and Parole and contains the name of any certified, licensed counselor who submits their name.


Law:
La. R.S. 42:1111C(2)(d) prohibits a public servant and a legal entity in which the public servant exercises control or owns an interest in excess of twenty-five percent, from receiving any thing of economic value for services rendered from a person who has or is seeking to obtain contractual or other business or financial relationships with the public servant's agency.


La. R.S. 42:1112B(1) prohibits a public servant, except as provided in R.S. 42:1120, from participating in a transaction involving the governmental entity in which, to his actual knowledge, any member of his immediate family has a substantial economic interest.


La. R.S. 42:1113A(1)(a) prohibits a public servant, or member of his immediate family, or legal entity in which he has a controlling interest from bidding on or entering into any contract, subcontract, or other transaction that is under the supervision or jurisdiction of his agency
