Advisory Opinion Request from Benjamin E. Jordan, Webster Parish Police Juror - District 12.
Facts:
Benjamin Jordan was recently elected as Webster Parish Police Juror for District 12. His current term ends on January 7, 2024.

Mr. Jordan is a volunteer firefighter with the Webster Parish Fire Protection District No. 3 ("Fire District"). The Webster Parish Police Jury appoints members to the Fire District Board, which oversees the operations of the Fire District.

The Webster Parish Police Jury appoints members to the Webster Parish Library Board of Control, which oversees the operations of the Library. The Library would like to hire Mr. Jordan's wife, Sherri Harris Jordan, on a part-time basis.

Law:
La. R.S. 42:1113A: No public servant shall bid on or enter into any contract, subcontract, or other transaction that is under the supervision or jurisdiction of the agency of such public servant.

La. R.S. 42:1123(30) provides an exception to the Code in that a public servant is not prohibited from donating services, movable property, or funds to his agency. However, nothing shall be construed to allow a public servant to make an appointment of a person which is otherwise prohibit by the Code.

La. R.S. 42:1119B(1): No member of the immediate family of a member of a governing authority shall be employed by the governmental entity.

Recommendations:
Adopt the proposed advisory opinion.
