A request for an advisory opinion, submitted by Clayton Harmson, inquiring about whether the Louisiana Code of Governmental Ethics would prohibit him from being a vendor for the Parish of Rapides after he was appointed to sit on the Buckeye Recreation District by the Rapides Parish Police Jury.
Facts:
Mr. Harmson stated that he owns a personal trucking business, which includes the hauling of dirt, sand, gravel, etc. Recently, he was appointed by the Rapides Parish Police Jury to sit on the Buckeye Recreation Board in Deville, Louisiana. He inquired as to whether he would be prohibited from being a vendor to the Parish of Rapides, while being a member of the Buckeye Recreation Board.
Law:
La. R.S. 42:1113B prohibits an appointed member of any board or commission, member of his immediate family, or a legal entity in which he has a substantial economic interest, from bidding on or entering into or being in any way interested in any contract, subcontract, or other transaction which is under the supervision or jurisdiction of the agency of such appointed member.
Recommendations:
Adopt the proposed opinion.
