Waiver request submitted by Martin Jackson , Northshore Harbor Center, regarding a $1500 late fee assessed for filing his 2017 Tier 2.1annual pfd 84 days late.
Facts:
Martin K. Jackson is seeking a waiver request of the $1500 late fee for the following reasons:

Mr. Jackson apologizes for the untimely submission of his Tier 2.1 Annual Disclosure while serving on the board for the Northshore Harbor Center.

Mr. Jackson stated his intent upon accepting this position was to serve his community. He serves as a member of the Men's Club for Aldersgate United Methodist Church and volunteers for several organizations. He owns a small business in Slidell and at the beginning of this year he was in the middle of expanding his company. Mr. Jackson stated this is a big step for his business and his family. He spends a good amount of time traveling to make sure it is successful. His company Gulf States Scientific, LLC has now opened in the Texas market and has a fully operational warehouse.

Also in the middle of pursuing this opportunity his eldest daughter got married on February 23, 2019. As it was a joyous occasion, the last six weeks prior to the wedding were chaotic and added to an already overloaded plate. At this time, Mr. Jackson received the letter alerting him of the delinquency. He stated once the mound of paperwork was sorted and prioritized, he submitted everything needed to be compliant. Mr. Jackson stated his wife spoke with someone who said just to get the documents in promptly and all would be ok which he thought was the case until he received the fine letter.

Mr. Jackson says at this time it would be a hardship to pay the fine because he has one daughter in graduate school out of state and another one in undergraduate college. Mr. Jackson is asking for the Board to waive the $1500 fine. He states this serves as an important lesson to him to pay attention to all letters and follow up, so not to have this type of situation happen again. He thanks the Board for their consideration.

Law:
La. R.S. 42:1124.2.1 requires financial disclosure for each member and designee of a board or commission which has the authority to expend, disburse or invest $10,000 or more of funds in a fiscal year on or before May 15th of each year during which the person holds office and the year following termination of the holding of such office.

La. R.S. 42:1124.4 of the Code provides that upon discovery of the failure to file, failure to timely file, omission of information or inaccurate information, the Board shall notify the filer by sending him a notice of delinquency by certified mail. The notice of delinquency shall inform the person that the financial statement must be filed, or that the information must be disclosed or accurately disclosed, or that a written answer contesting the allegation of such failure, omission, or inaccuracy must be filed no later than seven (7) business days after receipt of the notice of delinquency.

Recommendations:
Suspend all but $250 based on future compliance with the reporting requirements under the Code of Ethics. The $250 is payable within 30 days and if payment is not received within 30 days, the full amount of the late fee becomes due and owing.
