Advisory opinion regarding whether a Captain of a Fire Station for the St. George Fire Department or any of his firefighters/first responders may refer victims to the services of CLEAR Restoration, LLC/1-800-BoardUp of Greater Baton Rouge of which the Captain is an employee.
Facts:
CLEAR Restoration, LLC is a water, fire damage and mold remediation company. It specializes in restoring homes and businesses to their pre-loss condition quickly and cost effectively. CLEAR Restoration also has a Division called 1-800-BoardUp of Greater Baton Rouge that provides emergency board-up and structural stabilization services for homes and businesses affected by fire and structural damage.

Often, the victims of a catastrophe are looking for immediate assistance and turn to the first responders who are on the scene first. The employees of the St. George Fire Department are seeking an opinion as to whether they may refer the victims to CLEAR Restoration for its services.

A Captain for one of the fire stations within the St. George Fire Department is an employee of CLEAR Restoration.


Law:
La. R.S. 42:1112A prohibits a public servant from participating in a transaction involving his governmental entity in which he has a substantial economic interest.
La. R.S. 42:1112B(3) states that no public servant shall participate in a transaction involving the governmental entity in which, to his actual knowledge, any person of which he is an officer, director, trustee, partner, or employee has a substantial economic interest.
Recommendations:
Adopt proposed advisory opinion.
