RE:
Advisory opinion request and disqualification plan approval regarding whether the minor children of Jim Wendell may be employed as part-time score keepers with the Terrebonne Parish Parks and Recreation Department while Mr. Wendell serves as the Administrator of the Department.
Facts:
Jim Wendell was first employed with the Terrebonne Parish Parks and Recreation Department on March 24, 2019 as the part-time Field Director. On August 27, 2019, Mr. Wendell was promoted to the full-time position of Administrator. Roddy Litrell is the Director of the Terrebonne Parish Parks and Recreation Department. Mr. Wendell is his assistant. Mr. Litrell is responsible for all personnel decisions with the help of the Human Resource Director.

The children are minors who have been approved by the Louisiana Workforce Commission to work for Terrebonne Parish in the Parks and Recreation Department. The children would be hired as score keepers/clock operators. All matters involving the children will be handled by Roddy Litrell, Director of the Department.


Law:
La. R.S. 42:1119A states that no member of the immediate family of an agency head shall be employed in his agency.

La. R.S. 42:1112B(1) states that no public servant shall participate in a transaction involving the governmental entity in which, to his actual knowledge, any member of his immediate family has a substantial economic interest.
La. R.S. 42:1112C allows a disqualification plan to be developed in accordance with rules adopted by the Board to remove a public servant from participating in transactions that would otherwise present violations of Section 1112 of the Code.


Recommendations:
Adopt proposed advisory opinion. Approve disqualification plan.
