RE:
Request for an advisory opinion from the Jefferson Parish (pop. 432,552) Department of Governmental and Ethics Compliance questioning whether the Director of Transit for Jefferson Parish should recuse herself when voting on the Regional Planning Commission Board.
Facts:
Ninette Barrios is the Director of Transit for Jefferson Parish. As the Director of Transit, Ms. Barrios is federally mandated to serve as a committee member on the Regional Planning Commission and on the Transportation Policy Committee.

The Regional Planning Commission is a board comprised of local elected officials and citizen members from the parishes of Jefferson, Orleans, Plaquemines, St. Bernard, St. Charles, St. John the Baptist, St. Tammany, and Tangipahoa Parishes.

The Transportation Policy Committee is the Metropolitan Planning Organization board for the New Orleans, Covington-Mandeville, Slidell, and South Tangipahoa urbanized areas.

At times The Regional Planning Commission and the Transportation Policy Committee address matters related to Jefferson Parish transit projects.


Law:
La. R.S. 42:1112A prohibits a public servant, except as provided in R.S. 42:1120, from participating in a transaction in which he has a personal substantial economic interest of which he may be reasonably expected to know involving the governmental entity.

La. R.S. 42:1112B prohibits a public servant, except as provided in R.S. 42:1120, from participating in a transaction in which, to his actual knowledge (1) any member of his immediate family, (2) any person in which he has a substantial economic interest; (3) any person of which he is an officer, director, trustee, partner, or employee; (4) any person with whom he is negotiating or has an arrangement concerning prospective employment, or (5) any person who is a party to an existing contract with such public servant, has a substantial economic interest.

La. R.S. 42:1112D prohibits an appointed member of any board or commission, except as otherwise provided in R.S. 42:1120.4, from participating or being interested in any transaction involving the agency when a violation of R.S. 42:1112 would result.


Recommendations:
Adopt the proposed advisory opinion.
