Waiver request submitted by Sybil Haydel Morial, with the New Orleans Science and Mathematics Charter School, regarding a $1500 late fee assessed for failing to file her 2018 Tier 3 annual pfd.
Facts:
Ms. Morial is requesting a waiver request for not filing her 2018 annual personal financial disclosure statement. She also requested to appear before the Board of Ethics regarding this matter. On February 7, 2018, Ms. Morial stated she was in an automobile accident that totaled her vehicle and left her hospitalized for 10 days with multiple fractures and injuries. After 10 days in the trauma unit at University Hospital, Ms. Morial stated she underwent a month of on-site physical therapy at the Touro Rehabilitation Unit. After being discharged, Ms. Morial stated she was confined to a wheelchair for a few weeks, then transitioned to a walker, and then eventually a cane. Ms. Morial stated that her mobility was severely limited and her time and energy was spent focusing on recovering from "what could have been a totally disabling incident." She stated she continued outpatient physical therapy several times a week at City Park Physical Therapy until May 2018. Ms. Morial stated during her rehabilitation, her personal affairs were not attended to in a timely manner and she had accumulated mail and outstanding/overdue bills. The last board meeting she attended was prior in January 2018, prior to her car accident. She states she has since resigned from the New Orleans Science and Mathematics Charter School Board.

Law:
La. R.S. 42:1124.3 requires persons holding a public office who represent a voting district having a population of less than 5,000 and each member of the governing authority or management board of a charter school created pursuant to Chapter 42 of Title 17 of the Louisiana Revised Statutes of 1950 to file a financial disclosure statement on or before May 15th of each year during which the person holds office and the year following termination of the holding of such office.

La. R.S. 42:1124.4 of the Code provides that upon discovery of the failure to file, failure to timely file, omission of information or inaccurate information, the Board shall notify the filer by sending him a notice of delinquency by certified mail. The notice of delinquency shall inform the person that the financial statement must be filed, or that the information must be disclosed or accurately disclosed, or that a written answer contesting the allegation of such failure, omission, or inaccuracy must be filed no later than seven (7) business days after receipt of the notice of delinquency.

Recommendations:
Suspend all but $850 based on future compliance with the reporting requirements under the Code of Ethics. The $850 is payable within 30 days and if payment is not received within 30 days, the full amount of the late fee becomes due and owing.
