A request for an advisory opinion, submitted by Mayor Ray Bourque, concerning whether the Louisiana Code of Governmental Ethics ("Code") would prohibit the continued employment of Holly Cope-Lynn as the City of Broussard's Director of Tourism and Communications if the City of Broussard awarded a financial advising contract to the financial services firm that employs her husband, Jerry Lynn.
Facts:
Mayor Bourque stated that Holly Cope-Lynn was hired in January to fill the Director of Tourism and Communications position for the City of Broussard. Mrs. Cope-Lynn reports directly to the Mayor. Mrs. Cope-Lynn does not supervise any employees. Mrs. Cope-Lynn is the sole employee in the Office of Tourism and Communications.
Her husband, Jerry Lynn, served as a financial advisor with Edward Jones and was the financial advisor for the City's retirement account. Recently, Mr. Lynn has switched firms and has asked if the City of Broussard would transfer their financial services to his new firm. The City of Broussard City Council approves the contract and the Mayor of the City of Broussard, signs the contract with financial advising firm on behalf of the City.
Law:
La. R.S. 42:1111(C)(2)(d) provides that no public servant shall receive any thing of economic value for or in consideration of services rendered, or to be rendered, to or for any person who has or is seeking to obtain a contractual, business, or financial relationship with the public servant's agency.
Recommendations:
Adopt the proposed opinion.
