RE:
Request for an advisory opinion on behalf of Vermilion Parish Police Juror, Dexter Callahan, relative to whether he can accept compensation from Bonaventure Co. Fire Fighting which has sold fire trucks to the Vermilion Parish Police Jury.
Facts:
Dexter Callahan was recently elected to the Vermilion Parish Police Jury.

Bonaventure Co Firefighting provides firefighting equipment to fire departments and agencies in Louisiana, Mississippi, and Alabama. Bonaventure has sold fire trucks to the Vermilion Parish Police Jury in the past and may sell trucks in the future.


Prior to Dexter Callahan becoming a police juror he was paid by Bonaventure to deliver trucks from its South Dakota facility to recipients in Louisiana and other states. Mr. Callahan does not have an ownership interest, nor is in an officer in Bonaventure and is paid on a per trip basis without executing a contract.

Mr. Callahan seeks an opinion on whether he can receive compensation from Bonaventure now that he is a Vermilion Parish Police Juror.


Law:
La R.S. 42:1111C(2)(d) prohibits a public servant and a legal entity in which the public servant exercises control or owns an interest in excess of twenty-five percent, from receiving any thing of economic value for services rendered from a person who has or is seeking to obtain contractual or other business or financial relationships with the public servant's agency

La. R.S. 42:1112A prohibits a public servant, except as provided in R.S. 42:1120, from participating in a transaction in which he has a personal substantial economic interest of which he may be reasonably expected to know involving the governmental entity.

Recommendations:
Adopt the proposed advisory opinion draft.
