Request to waive the $800 late fee assessed against Chester Stroyny for filing his 2020 lobbying registration 16 days late.
Facts:
Mr. Stroyny is requesting to amend his registration and receive a revised assessment of the late fee. He first registered as an executive branch and legislative branch lobbyist stating that his first action occurred on January 21, 2020. He says that his first action occurred on February 5, 2020 when he had a meeting with an executive branch official. He states he is a contract worker with 3M which contracts with MultiState Associates for lobbying compliance services. He stated that he notified MultiState in late January of his upcoming meetings and mistakenly listed that date as the start date. He provided a copy of the calendar invite for the meeting.

Law:
R.S. 49:74A and 24:53A provide that "[e]ach lobbyist shall register with the ethics board as soon as possible after employment as a lobbyist or after the first action requiring his registration as a lobbyist, whichever occurs first, and in any event not later than five days after employment as a lobbyist or not later than five days after the first action requiring his registration as a lobbyist, whichever occurs first." R.S. 24:51(5) defines a legislative branch lobbyist as either of the following:
(a) (i) Any person who is employed or engaged for compensation to act in a representative capacity for the purpose of lobbying if lobbying constitutes one of the principal duties of such employment or engagement.

(ii) Any person who acts in a representative capacity and makes an expenditure.

(b) However, "lobbyist" shall not mean any person who does not make any direct act or have any direct communication with a legislator for the purpose of influencing the passage or defeat of any legislation. R.S. 49:72(7) defines an executive branch lobbyist as "any person who acts in a representative capacity and makes an expenditure."

Recommendations:
Waive the late fee.
