RE:
Request for an advisory opinion from J. Mitchell Ourso, Jr. on behalf of the Iberville Parks and Recreation District relative to paying an employee of the Iberville Parish Council to cut grass at the Recreation District.
Facts:
The Iberville Parish Parks and Recreation District ("IPRD") was created by State law in 1983 and was governed by the Iberville Parish Police Jury. In 2019, State law was amended whereby the Iberville Parish Council became the governing authority of the IPRD. Prior to the change in governing authority, an Iberville Parish Council employee had a contract to cut the grass of the IPRD. The contract to cut grass between William Kimball, who is employed with the Iberville Parish Department of Public Works and the IPRD was dated February 14, 2018 was for a one year term.
Law:
La. R.S. 42:1113A(1)(a) prohibits a public servant, or member of such public servant's immediate family, or legal entity in which he has a controlling interest from bidding on or entering into any contract, subcontract, or other transaction that is under the supervision or jurisdiction of the agency of such public servant.

La. R.S. 42:1102(2)(a)(vi) defines "agency of the public servant" to mean the agency in which the public servant serves.


Recommendations:
