RE:
Request that the Board waive a $1,800 campaign finance late fee assessed against John Neal, in his capacity as a candidate for State Representative, 87th Representative District, in the October 12, 2019, whose 10-G campaign finance disclosure report was filed 30 days late.
Facts:


John Neal requested a waiver and states the following:
In November he received a telephone call from the Ethics Board indicating he completed the required forms but the form did not submit. He states a staff member walked him through the completion and form submission on November 15, 2020, at that time he was advised that he was complete.

On October 15, 2020, staff sent him letters pointing out errors on report and asking Mr. Neal to submit amendments.

On November 12, 2020, staff left message for Mr. Neal about the amendments. Mr. Neal called on November 14, 2020 and staff explained about amendments and filing 10-G. On November 15, 2020, candidate called and staff offered to walk him through on how to amend when he was on his computer. On November 26, 2020, staff left message for Mr. Neal. On December 6, 2020, Mr. Neal called and staff assisted with filing amendment and 10-G.

18:1505.4.A(1) Any candidate, the treasurer or chairman of a political committee, or any other person required to file any reports under this Chapter, who knowingly fails to file or who knowingly fails to timely file any such reports as are required by this Chapter may be assessed a civil penalty for each day until such report is filed.




Section 1205C of the Rules for the Board of Ethics provides that "[i]f a report is filed more than 10 days late and the amount of activity on the report is less than the amount of the late fee to be assessed, the staff may reduce the late fee to the amount of activity or 10 times the per-day penalty, whichever is greater."

Recommendations:
Reduce to $600.
