RE:
Request that the Board waive the $2,000 and $2,000 campaign finance late fees assessed against Britton Carroll, a candidate for Assessor, Grant Parish, in the October 12, 2019 election, whose 10-P and 10-G campaign finance disclosure reports were filed 152 and 117 days late, respectively.
Facts:


Britton Carroll requests a waiver and states the following:

When he viewed the LEADERS system, he saw that a 10-P had been completed, However, for whatever reason it did not submit and that is his negligence for not following up at the time. There had been no changes since that report in regard to expenditures. It's difficult for a one-man operation to keep up with all that had to be done. He used personal funds, about $2,500 for the campaign, money he received from selling his boat motor. Had he been well funded, and had a staff to manage his campaign, then he's sure these accidents wouldn't have occurred. Currently he would not be able to pay any fine, as he has no job and no source of income. He had to go out of business and sell his house because he lost over $70,000 in two years due to operating expenses. He currently has no vehicle.

Staff Notes:

Mr. Carroll created the 10-P on October 2, 2019, but did not submit it until March 2, 2020. The 10-G was created and submitted on March 2, 2020.

Law:
18:1505.4.A(1) Any candidate, the treasurer or chairman of a political committee, or any other person required to file any reports under this Chapter, who knowingly fails to file or who knowingly fails to timely file any such reports as are required by this Chapter may be assessed a civil penalty for each day until such report is filed. 18:1484.(2)(b). Each candidate for any other public office shall file reports of contributions in excess of two hundred dollars in the aggregate during the aggregating period.



Section 1205C of the Rules for the Board of Ethics provides that "[i]f a report is filed more than 10 days late and the amount of activity on the report is less than the amount of the late fee to be assessed, the staff may reduce the late fee to the amount of activity or 10 times the per-day penalty, whichever is greater."

Recommendations:
1) Reaffirm reassessment of $60 suspended late fee for the 2018 Supplemental.


2) For 10-P - Reduce $2,000 late fee to $600; and, suspend all but $200 of the $600 late fee based on future compliance.

3) For 10-G - Reduce $2,000 late fee to $600; and suspend all but $200 of the $600 late fee based on future compliance.
