RE:
Request that the Board waive a $480 campaign finance late fee assessed against Robert H. "Bob" Titus, a candidate for State Representative, 96th Representative District, in the October 12, 2019, whose 10-G campaign finance disclosure report was filed 8 days late.
Facts:
Robert Titus requests a waiver and states the following:

This was his first-time running for an elected office. He did not file the 10-G report because it was his understanding that filing the 10-G report was NOT necessary because he was not in the general election. He called the Board of Ethics to inquire about the 10-G filing and was told that he did not have to file because he was not in the general election. After receiving the Late Fee Assessment Letter, he called and was clarified on the point that he still was required to file a report even though he was not in the general election. He apparently misunderstood that point. His misunderstanding of the issue(s) was not with intent or malice to file late and may have some shared miscommunication with the Ethics Board personnel.

Staff Notes:

Staff spoke with him to help him file his 30-P and 10-P reports. During the conversation about the 10-P report, staff advised Mr. Richmond to take notes on how to file in the future. Candidate, as an electronic filer in the primary election, was sent an email reminding about the 10-G reporting requirement.

18:1505.4.A(1) Any candidate, the treasurer or chairman of a political committee, or any other person required to file any reports under this Chapter, who knowingly fails to file or who knowingly fails to timely file any such reports as are required by this Chapter may be assessed a civil penalty for each day until such report is filed.
