RE:
Request that the Board waive a $480 campaign finance late fee assessed against Thomas Rodrigue, a candidate for Sheriff, Lafourche Parish, in the October 12, 2019 election, whose 10-G campaign finance disclosure report was filed 8 days late.
Facts:
Thomas Rodrigue and Angelique Avasso, his report preparer, request a waiver and state the following:

This is his first time running for office. They were both new to the forms and didn't file the proper paperwork in time.

Staff notes:

On October 31, 2019, the candidate, as an electronic filer, was sent an email as a reminder to file the 10-G report. On November 8, 2019, a notice of delinquency was mailed to the candidate. On November 14, 2019, the candidate called and said he received the notice of delinquency and his report preparer was in the hospital and forgot to send it. He said she sent it the day before he called. However, after staff check, it was the EDE-P, not the 10-G. Staff asked the candidate to have his report preparer call her and she would it explain it. Later that day, the report preparer called and staff explained what report needed to be filed. The report was filed on November 14, 2019, with the only activity reported was an expenditure to make a repayment of a loan from the candidate.

Law:
18:1505.4.A(1) Any candidate, the treasurer or chairman of a political committee, or any other person required to file any reports under this Chapter, who knowingly fails to file or who knowingly fails to timely file any such reports as are required by this Chapter may be assessed a civil penalty for each day until such report is filed.

18:1495.4D(1) If the final report of a candidate for an election, as required by Paragraph (5), (6), or (7)of Subsection B of this Section, shows a deficit or a surplus, the candidate and his treasurer, if any, shall file supplemental reports with the supervisory committee of all information required in R.S. 18:1495.5. Such reports shall be filed annually no later than February fifteenth and shall be complete through the preceding December thirty-first. Such a supplemental report shall be filed each year until a report has been filed which shows no deficit and until any surplus campaign funds have been disposed of in accordance with R.S. 18:1505.2(I). The report on surplus funds shall disclose the disbursement of such funds in the same manner as expenditures are reported.

Recommendations:
Suspend all but $200 based on future compliance and payment within 30 days.
