RE:
Advisory opinion regarding whether Phil Ashurst, the Operations Director of Cajundome Commission may accept employment with Populous, Inc. within two years of the termination of his employment with the Commission.
Facts:
Phil Ashurst stated that he is employed by the Cajundome Commission as an Operations Director and intends to retire in April 2020. He stated that as an Operations director, he receives supervision from the Executive Director and exercises supervision over four different departments. He also stated that as an Operations Director, he does not have the authority to select the companies who provide architectural work for the Cajundome. He stated while employed with Cajundome, he has worked with and participated in multiple projects with Company A- Popolous, Inc., an out of state architectural firm. He also stated that that he has worked on and participated in several projects involving Company B-Sellers Broussard Joint Venture. He stated that for each of the projects he has worked on with the companies while employed by Cajundome Commission, Rajun Cajun Facilities, Inc. was the entity that hired and paid the architecture firms. He stated that after he retires he intends to work for Populous, Inc. but does not intend to receive any compensation from Cajundome for or with Company A- Populous, Inc.
Law:
La. R.S. 42:1121A(1): No former agency head or elected official shall, for a period of two years following the termination of his public service as the head of such agency or as an elected public official serving in such agency, assist another person, for compensation, in a transaction, or in an appearance in connection with a transaction, involving that former agency or render any service on a contractual basis to or for such agency.


La. R.S. 42:1121D: No former public servant shall share in any compensation received by another person for assistance which such former public servant is prohibited from rendering.


Recommendations:
Adopt proposed advisory opinion.
