Advisory Opinion regarding whether the Code of Governmental Ethics would prohibit Jamie Boudreaux's daughter, Jolie Boudreaux, from becoming the Head Librarian for Cameron Parish while he serves on the Cameron Parish Library Board.
Facts:
Mr. Boudreaux provided that Jolie started her employment with the Library in 2009, about the same time she started toward her Masters in Library Science. She was awarded her Masters in Library Science in 2019. Mr. Boudreaux stated that he was appointed to the Cameron Parish Library Board in December of 2011. Jolie is currently a part time employee in the Grand Lake branch library. There are six separate branch libraries in the Cameron Parish Library System. Each library branch has a full time librarian. The Head Librarian is over all six branch libraries. Mr. Boudreaux stated that he is willing to recuse himself from participation in the selection process for the new Head Librarian and if necessary he is willing to resign from the Library Board to allow his daughter to pursue her dreams of being Head Librarian.
Law:
La. R.S. 42:1119A provides that no member of the immediate family of an agency head shall be employed in his agency.

La. R.S. 42:1119C(2) provides a limited exception to the general nepotism prohibition and allows the continued employment and normal promotional advancement of a public employee when a member of the public employee's immediate family becomes the agency head of the public employee's agency, provided that such public employee has been employed in the agency for a period of at least one year prior to the member of the public employee's immediate family becoming the agency head.

La. R.S. 42:1102(3) defines "agency head" to mean the chief executive or administrative officer of an agency or any member of a board or commission who exercises supervision over the agency.

Recommendations:
Adopt draft advisory opinion.
